The Daily CAFE Privacy Policy

This privacy policy (this “Policy”) describes how Educational Design, LLC, d.b.a. “The 2 Sisters” and our subsidiaries and affiliates (collectively, “The 2 Sisters”, “we” or “us”) collect, share and use your personal information.  This Policy applies to visitors and users (individually “you”) of our website www.thedailycafe.com and any other site, service, social media page or application (collectively, the “Sites”), owned and/or operated by us that states that it is governed by this Policy.

By visiting or using our Sites, to the extent permitted by applicable law, you are consenting to us gathering and processing information about you in accordance with this Policy, although consent may not be required for all of the elements described in this Policy. For particular types of information or processing, we may provide you with choices or request your further consent related to what information we collect and how we may process it.

Third-parties (such as parties you link to through our Sites and social networks that you use in connection with our Sites) may also collect, use, and share information about you. This Policy does not cover such third-parties or their services and we do not take any responsibility for how such third-parties may use any information they collect. For information about third-party privacy practices, please consult with them directly.

Collection and Use of Personal Information

We may collect the following types of personal information from you: (i) contact information such as name, email address, mailing address, phone number; (ii) billing information such as credit card number, and billing address; (iii) unique identifiers such as user name, account number, password; users have the option to provide photos, bios, titles, and determine whether they be private or public; and (iv) preference information such as purchase history and marketing preferences. 

We may also collect information from you such as IP address, browser type, referring/exit pages, and operating system through cookies and other technologies.

We may combine the information we collect from you over time and we may combine such information with information that is publicly available, collected through cookies and other technologies, and information that we receive from our partners, affiliates and other third parties. 

We may use this information to: (i) fulfill orders; (ii) send you an order confirmation; (iii) design and offer our products and services; (iv) send you requested information; (v) send you product and pricing updates, warranty information, or changes to our policies or terms; (vi) respond to your requests; (vii) administer your account; (viii) send you a newsletter; (ix) send you marketing communications; (x) respond to your questions and concerns; (xi) improve our Sites, products, services and marketing efforts; (xii) conduct research and analysis; (xiii) display content based upon your interests; (xiv) prevent and detect fraud or abuse; (xv) comply with applicable legal requirements; or (xvi) facilitate your interactions with other users. 

Cookies and Other Technologies

We receive and store certain types of information whenever you interact with us. For example, like many websites, we use technologies such as cookies and clear gifs to obtain certain types of information when your web browser accesses one of our Sites, or when you are provided the opportunity to complete surveys, participate in a sweepstakes or other incentives, or open or respond to any newsletter or other e-mail.

A “cookie” is a small file that resides on your computer, mobile phone, or other device, and allows us or our business partners to recognize your device when you return to our websites and record information about your usage of our Services. "Clear gifs" are tiny graphics with a unique identifier, similar in function to cookies, and may be used to track the online movements of web users or to let us know if you have opened an e-mail that we sent you.

We use cookies in order to allow us to operate our Sites. For example, they are required to help you access secure areas (such as your account pages).  We may also use cookies, or similar technologies, to enhance the performance and functionality of our Sites, for analytics and customization, to regulate advertising, or to allow visitors to share our pages and content through third-party social networking websites.

Our business partners may also use cookies, or similar technologies, on our Sites for the same general purposes identified in this Policy, including to improve their own marketing, products or services.

You are always free to decline cookies if your browser permits; although, by declining the use of cookies you may not be able to use certain features on our Sites. Also, because information we obtain may be combined, we may still be able to identify your web browser, computer or mobile device when you access our websites even if you disable cookies. Some browsers incorporate a “Do Not Track” (DNT) feature that, when turned on, signals to websites and online services that you do not wish to be tracked. Because there is not yet an accepted standard for how to respond to browser DNT signals, we do not currently respond to them.

Information Sharing

We may share our data, including personal information about you, with our affiliated entities and joint ventures when it is reasonably necessary for the purposes otherwise permitted in this Policy.

We may share your information with non-affiliated third-parties as set out below, but only as permitted by law. 

We may provide your personal information to companies that provide services to us, such as merchant services, payment processing, shipping, or customer service.

We may share your personal information with other companies or organizations which are not affiliated with us including third parties offering services to you, and third parties who perform data analytics. These companies and organizations may use the information we share, often in combination with their existing information, to provide, or help other companies provide, offers or services to you, to market products, services or opportunities to you, and to perform data analytics based on your personal information.  If you respond to a third party offer, your information will be subject to that third party’s privacy policies.

Third parties who use cookies or other technologies on our Sites, may use cookies and other technologies to collect information about your online activities over time and across different websites.  Companies that we share information with may use the information we provide to them, often in combination with their existing information, to provide you with more relevant advertising. You may opt out of receiving personalized advertisements from advertising companies that are members of the Network Advertising Initiative or who subscribe to the Digital Advertising Alliance’s Self-Regulatory Principles for Online Behavioral Advertising by visiting http://www.networkadvertising.org/choices and http://www.aboutads.info/choices.

We may also disclose your personal information (i) as required by law, such as to comply with a subpoena, or similar legal process; (ii) to protect our rights, protect your safety, or protect the safety of others; (iii) to investigate fraud, or respond to a government request; (iv) as part of any merger, sale of company assets or acquisition, as well as in the event of an insolvency, bankruptcy or receivership, in which case information would be transferred as one of the business assets of the company; and (v) otherwise with your prior consent to do so.

If you choose to participate in a special event (for example, a promotion, contest, or sweepstakes), we may share your personal information with those organizations participating in the applicable event.

We may, and we may authorize third parties to, create aggregate records from your personal information by excluding information that makes the information identifiable. We may use and disclose, and authorize third parties to use and disclose, aggregate non-personal information at our discretion.

External links

Our Sites may provide links to third-party websites which are outside our control and not covered by this Policy. We encourage you to review the privacy policies posted on these (and all) websites.

Our Sites may include social media features, such as the Facebook Like button and widgets, such as the ShareThis button or interactive mini-programs that run on our site. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our websites. Your interactions with these features are governed by the privacy policy of the company providing it.

Security

We use a variety of security measures to protect against loss, misuse and alteration of your personal information under our control. While we strive to safeguard your personal information, we cannot guarantee or warrant the security of any information you disclose or transmit to us.

Accessing and updating your information

If you have created an account you can review and change certain personal information relating to your account at any time by logging on to your account. Otherwise, to learn more about accessing or updating your information, or to make requests regarding your personal information, please contact us as set forth below.

We may reject requests that are unreasonable or not required by law, including those that would be impractical, could require disproportionate technical effort, or could expose us to operational risks such as fraud. We may retain information as required or permitted by applicable laws and regulations, including to honor your choices, for our billing or records purposes and to fulfill the purposes described in this Policy.

Choice/Opt-Out

We want to communicate with you only if you want to continue to hear from us.

To opt out of receiving email promotions that we send you: (1) follow the unsubscribe instructions in any of our promotional emails; or (2) write to Tim Schroeder at the address specified below (a "postal request"). To opt out of telephone promotions, you can tell us when we call you or you can send us a postal request. To opt out of postal mail promotions, please send us a postal request.

Opting out of promotional communications with us does not affect our communications with you via telephone or email related to any business we may have with you as a customer or other transactional emails.

Minor children

Our Sites are not directed at children and we do not knowingly solicit or collect personal information from children online. If you are under the age of 18 (or a minor in the jurisdiction in which you are accessing our websites), you may only use our Sites with the involvement of a parent or guardian.  If we learn that we have collected personal information online from a child under the age of 18, we will delete the data from our systems.

Your California privacy rights

If you are a California resident and would like a copy of our notice describing what categories of personal information we share with third parties or corporate affiliates for their direct marketing purposes and the names and addresses of the third parties and affiliates that received your information in the past year, please submit a written request to Tim Schroeder at the address below; Attn: California Privacy. Please allow up to 30 days for us to process your request. You may submit such a request once per year.

Visitors from outside of the United States

We are headquartered in the United States of America and our servers are located in the United States and subject to the applicable state and federal laws of the United States.  If you choose to use our websites from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. laws, then please note you are transferring your personal information outside of those regions to the United States for storage and processing.  Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating our business. By providing any information, including personal information, to us, you consent to such transfer, storage, and processing.

Release

You agree, to the extent permitted by law, to release and hold us, and our members, managers, employees, affiliates, and agents harmless from any claim or demand, including reasonable attorney's fees, arising out of any unauthorized release, dissemination, access, harm to, or destruction of your personal information.

Changes

We may update this Policy in the future, you should check this Policy frequently for changes. When we make material changes to this Policy, we will notify you by posting the updated Policy on our Sites, and we will update the effective date at the end of this Policy.  Our use of information gathered or obtained at any time is subject to the Policy in effect at the time of such use, as permitted by law.  If you do not agree to the terms of this Policy or any modified version of this Policy, your sole recourse is to terminate your use of our Sites.
